These Terms and Conditions of Use ("Terms") govern your access to and use of the websites at https://www.wittetravel.com, https://www.wittetours.com, and https://bookings.wittetravel.com (collectively, the "Website") operated by Witte Associates, Inc. dba Witte Travel & Tours ("Witte," "we," "us," or "our"), located at 3250 28th Street SE, Grand Rapids, MI 49512, United States.
By accessing or using the Website or obtaining any content, products, or services through our offices or Website, you, the purchaser, traveler, and/or participant, agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Website or our services. No alterations to these Terms may be made by any Witte employee, representative, or agent unless in writing by an authorized officer of Witte.
In these Terms, "you" and "your" refer to the individual or entity using the Website or our services. "Services" means vacation travel planning, custom group tours, performance tours, spiritual journeys, student and alumni travel, group flights, river and ocean cruising, and related travel arrangements we may provide. Website content about destinations, itineraries, and tour experiences is provided for general information; it is not a binding offer until confirmed in a separate written quote, proposal, brochure, registration form, or booking agreement accepted by you and Witte.
Travel Bookings and Payments
Tour and travel arrangements are subject to availability, supplier terms, and the specific conditions in your booking documents or tour brochure, including deposit requirements, payment schedules, cancellation and refund policies, travel insurance options, and any applicable fees. Specific tour terms (including cancellation penalties and inclusions) vary by itinerary and are set out in the materials provided for that tour. You are responsible for reviewing and accepting those conditions before confirming travel. Reservations generally cannot be made by telephone alone and typically require a completed registration form and deposit. Failure to pay on time or to provide required traveler information may result in cancellation of reservations and forfeiture of payments as set out in your booking documents. Tour costs may be subject to post-purchase price increases due to supplier or government charges, fuel surcharges, taxes, foreign exchange fluctuations, and/or changes in group size; where applicable, your registration indicates consent as described in your booking materials.
Traveler Responsibilities
You are responsible for valid identification, passports or visas where applicable, health requirements, and travel insurance appropriate for your itinerary. For international travel, passport validity requirements vary by destination; check your booking materials and apply for documents early. You must follow instructions from tour managers, transportation operators, venue staff, and authorities. Witte is not responsible for denial of boarding or entry, missed connections, or costs arising from incomplete documentation or failure to meet health or entry requirements.
Group Travel Risks
Group travel by air, motorcoach, ship, rail, or other means involves inherent risks, including weather, traffic, scheduling changes, walking on uneven terrain, and venue availability. Tour activity levels vary by itinerary. By using our Services or traveling on tours we arrange, you acknowledge these risks. To the fullest extent permitted by law, you agree that Witte is not liable for risks inherent in group travel, or for the acts, omissions, or default of independent travel suppliers, beyond our obligations in your booking agreement.
Intellectual Property
Unless otherwise stated, Witte and its licensors own all content on the Website, including text, photographs, graphics, logos, itineraries, and layout. All rights are reserved. You may view and print pages for personal, non-commercial use subject to these Terms. Apart from fair dealing for private study, research, criticism, or review as permitted by law, no part may be reproduced or reused for any other purpose without prior written permission from Witte.
User Submissions
If the Website allows comments, reviews, contact form messages, proposal requests, or other submissions, you grant Witte a non-exclusive, royalty-free, perpetual license to use, reproduce, modify, and display such content in connection with our business. You represent that your submissions do not infringe third-party rights and are not unlawful, defamatory, or invasive of privacy. We may remove submissions at our discretion and are not obligated to monitor all user content.
Prohibited Uses
You agree not to: use the Website for unlawful purposes; attempt to gain unauthorized access to systems or data, including the TRIP reservation portal; interfere with Website operation; scrape or harvest data without permission; impersonate others; transmit malware; or use the Website to send unsolicited commercial messages. Passwords used for registration on our sites are for individual use only; you are solely responsible for safeguarding your password.
Third-Party Services and Links
The Website may reference or link to hotels, attractions, cruise lines, insurers, payment processors, and other third parties. We do not control and are not responsible for third-party products, services, or websites. Your dealings with third parties are solely between you and them.
Disclaimer of Warranties
To the maximum extent permitted by applicable law, the Website and its content are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Website will be uninterrupted, error-free, or free of harmful components, or that information on the Website is complete, current, or accurate.
Limitation of Liability
To the maximum extent permitted by applicable law, Witte and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Website or reliance on Website content. Our total liability for claims arising out of or relating to the Website (excluding claims governed by a signed booking agreement) will not exceed one hundred U.S. dollars (US $100) or the amount you paid us for the specific transaction giving rise to the claim, whichever is greater. Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law. Nothing in these Terms limits liability for death or personal injury caused by our negligence, fraud, or other liability that cannot be excluded by law.
Indemnity
You agree to indemnify and hold harmless Witte and its affiliates from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the Website, violation of these Terms, violation of law, or infringement of third-party rights.
Governing Law and Disputes
These Terms are governed by the laws of the State of Michigan, United States, without regard to conflict-of-law principles. You agree that exclusive jurisdiction for disputes relating to these Terms or the Website lies in the state or federal courts located in Kent County, Michigan, and you consent to personal jurisdiction there. Where your booking agreement provides for binding arbitration, that agreement controls for disputes arising from the booked tour.
Changes to These Terms
We may revise these Terms at any time by posting an updated version on the Website with a new effective date. Your continued use of the Website after changes constitutes acceptance of the revised Terms, to the extent permitted by law.
